Terms and Conditions of Use of Services of ASAA88
1. General
1.1.
These Terms and Conditions govern the contractual relationship between the Player (hereinafter referred to as the “User”) and ASAA88.
1.2.
The User agrees that by using or visiting any section of our website www.ASAA88.com or any other websites, owned by ASAA88, via TV, pc, mobile devices or any other communication mediums to access the gaming services including downloadable applications (the “Website”) and/or register on the website that they consent to be bound by these Terms and Conditions and the (i) account registration procedures (ii) all gaming and gaming transactions (iii) our Privacy Policy and (iv) the Rules of the games (in aggregate hereinafter referred to “T&C”).
1.3.
The User must read these T&C carefully in their entirety before clicking on the “ACCEPT” button. If the User does not agree with any provision of these T&C the User must not use or continue to use the Website.
1.4.
These T&C come into force as soon as the User clicks on the “ACCEPT” button. By clicking “ACCEPT” the User signifies that he has read and understands the T&C and agrees to be a party to the contractual relationship between the User and ASAA88.
1.5.
ASAA88 reserve the right to edit, modify, supplement and to amend the T&C between the User and ASAA88 at any time. ASAA88 will use all reasonable efforts to ensure that the Users are notified of any change to the T&C. If the User does not accept any changes made they should stop using the services and close their account. The continued use of the website after the date which the changes come into effect shall be deemed to be an acceptance of the changes by the User
1.6.
ASAA88 is regulated by Myanmar Gaming Authority.
1.7.
These T&C constitute a contractual and legally binding agreement between the User and ASAA88.
1.8.
In the case of any inconsistency between these Terms and Conditions and game specific terms and conditions, it is the latter, which shall prevail. Where any aspect of game specific terms and conditions is not covered but is provided for in these Terms and Conditions, then it shall be deemed to apply to the relationship of the player with ASAA88.
1.9.
The User fully understands and agrees to be bound by these T&C as may be amended by from time to time
1.10.
Such amendments will become effective immediately upon being posted on www.ASAA88.com. It is the User’s sole responsibility to review the T&C, together with the specific Rules for each Game the User choose to participate in, in order to remain updated with all amendments each time the User plays. The User can easily identify whether these T&C have changed by referring to the Version number and the date of the current T&S stated on this page. Without prejudice to the foregoing, the company shall however pre-notify the User prior to a substantial amendment being made to the terms and conditions and in any such case the User shall receive a summary of any change carried out.
1.11.
Rules and explanations for participating in any of ASAA88’s Games, maintaining the User account with ASAA88, Privacy Policy, and other important information is provided in separate links on the Website and are incorporated into these T&C by reference.
1.12.
Without prejudice to clause 1 above, any reference to ASAA88’s Games in this agreement shall refer to Casino, Rush Poker, and other Games as may from time to time become available on the Website. ASAA88 reserve the right to add and remove Games from the Website at its own discretion.
1.13.
These T&C are published in a number of languages for information purposes and ease of access by Users. It is only the English version that is the legal basis of the relationship between the User and ASAA88 and in case of any discrepancy between a non-English version and the English version of these T&C, the English version shall prevail.
2. The User Member Account
2.1.
Registration and opening of the User member account:
2.1.1.
In order to participate in any of ASAA88’s Games for real money, the applicant must be 18 years of age to register an account with ASAA88 (“Member Account”) and place money into the Member Account in the way stipulated on the following page: page: sign-up.
2.1.2.
Residents of the United States, Philippines and HongKong are not allowed to open an account with ASAA88.
ASAA88 regularly screens its registrations for anomalies and will immediately and indefinitely suspend any of these countries’ player accounts.
It is the User’s responsibility to determine the legal status of internet gambling in the User’s jurisdiction and act accordingly. The availability of the ASAA88 Website in any particular jurisdiction does not constitute an offer or invitation by ASAA88 to use the services offered by the ASAA88 Website. ASAA88 will accept no liability whatsoever with respect to actions by players where Internet gambling is illegal and/or which is in violation of this article of the Terms and Conditions.
2.1.3.
ASAA88 reserves the right to appoint Payment Solution Providers to act, receive and/or pay funds on behalf of ASAA88.
2.1.4.
Users cannot gamble, wager and place bets within the Myanmar Territory as mentioned on our gaming license.
2.1.5.
The User is allowed to have only one Member Account on this Website. If the User attempts to open more than one Member Account, all accounts the User tried to open may be blocked or closed.
2.1.6.
If the User notices that he has more than one Member Account under different names, the User shall notify ASAA88 immediately.
2.1.7.
A request to open a Member Account is made by completing the registration form and submitting it to ASAA88 online. ASAA88 reserve the right to refuse to open a Member Account
2.1.8.
All information supplied when registered MUST be accurate. The User must enter all mandatory information requested into the User’s registration form, in particular, the User’s identity, the User’s address and contact details, including a valid e-mail address, the User’s place of residence, relevant payment information, all of which must be true and correct. It is the User’s sole responsibility to insure that the information provided is true, complete and correct. Users are hereby notified that ASAA88 carries out verification procedures, whether itself or through third parties on User’s depositing money. The User may be requested to provide ASAA88 with additional documents, such as a copy of the passport, to verify his identity. The User’s Member Account may be blocked or closed if the User does not provide the requested information or documents or if such information or documents the User supplies is/are found to be false or misleading.
2.1.9.
As part of the registration process the User must choose a username and password to be able to login into the Website. It is the User’s sole and exclusive responsibility to ensure that the User’s login details are kept securely. The User shall not disclose his login details to anyone. ASAA88 is not responsible for any abuse or misuse of the User’s Member Account by third parties due to the User’s disclosure, whether intentional or accidental, whether active or passive, of his login details to any third party.
2.1.0.
The User is not allowed to transfer funds from the User’s Member Account to other Users or to receive money from other Users into the User’s Member Account.
2.1.11.
Selling / transferring and/or acquiring of accounts to / from other Users is always prohibited.
2.2.
Deposits into the User’s Member Account
2.2.1.
The User may only participate in any Game if the User has sufficient funds in the User’s Member Account. ASAA88 never gives the User any credit whatsoever for participation in any Game.
2.2.2.
All information required to deposit funds into the User’s Member Account, can be found under “My Account” and “Deposit” pages of the Website. The User can use any of the methods available to him as specified in these pages as may be amended from time to time. Please note that some of the methods may not be available in some countries.
2.2.3.
Depending on the method selected, deposits may incur charges. For current fees regarding depositing funds, see “My Account” and “Deposits” for each deposit method. The User’s bank may independently charge the User for bank wire transfers and other methods of payment.
2.2.4.
ASAA88 accept payments in multiple currencies. The User must choose one currency as the currency of the User’s Member Account. Any payments received by ASAA88 in a currency other than the one chosen by the User will be converted into the currency chosen at the prevailing exchange rate. Any exchange premiums are to be paid by the User.
2.2.5.
When using a credit or debit card for depositing funds, the User’s funds are credited when ASAA88 receive an approval and authorization code from the card’s issuing bank. Should ASAA88 not receive such approval and authorization code the User’s account will not be credited with those funds.
2.2.6.
ASAA88 reserve the right to use additional procedures and means to verify the User’s identity when effecting deposits into the User’s Member Account.
2.2.7.
ASAA88 do not grant any credit for the use of its services.
2.2.8.
Credit balances in the User’s Member Account will not bear interest.
2.3.
Account Administration.
2.3.1
ASAA88 operates the User’s Member Account, calculating the amount of money the User has staked or offered to stake on a bet, which represents the User’s potential exposure at any time (“Reserved Amount”) and calculating the User’s “Available to Bet” balance, from time to time, as well as settling bets made by the User with other User’s through the User’s participation in the Games.
2.3.2
The amount of money in the User’s Member Account which has not yet been staked on a matched bet is the User’s “Available to Bet” balance and will determine the User’s betting limit.
2.3.3
ASAA88´s calculations of the User’s “Reserved Amount”, “Available to Bet” balance and amounts owed by the User under the terms of this agreement will be final and, in the absence of any manifest error, will not be subject to any enquiry or investigation.
2.3.4
ASAA88 is allowed to set off any losses against any gains.
2.3.5
Any deposit made by the User into the User’s Member Account will be held for the User’s use until the User places a bid for a bet, or accepts a bet on the Website. ASAA88 then hold the amount staked awaiting the outcome of the Bet.
2.3.6
When the User has placed a bet on ASAA88’s website, ASAA88 will hold the amount staked awaiting the outcome of the Game, and declare a winner. At this point the bet is binding and cannot be cancelled nor can any amount held by ASAA88 as a stakeholder be withdrawn.
2.4.
Payouts
2.4.1.
When the outcome of a Game the User participates in becomes determined or where ASAA88 has confirmed the relevant result of an event and settled the markets, all winnings will be held for the use of the User’s Member Account.
2.4.2.
If ASAA88 mistakenly credits the User’s Member Account with winnings that do not belong to the User, whether due to a technical or human error or otherwise, the amount will remain property of ASAA88 and the amount will be transferred from the User’s Member Account. If prior to ASAA88 becoming aware of the error the User has withdrawn the funds that do not belong to him, without prejudice to other remedies and actions that may be available at law, the mistakenly paid amount will constitute a debt owed by the User to ASAA88. In the event of an incorrect crediting, the User is obliged to notify ASAA88 immediately by email.
2.5.
Withdrawals from the User’s Member Account
2.5.1.
The User may withdraw any amount up to the “Available to Bet” balance in the User’s Member Account by issuing ASAA88 with a valid notice of withdrawal on the Website.
2.5.2.
To free the User’s Member Account balance and withdraw all the User’s funds, the User must first cancel any stakes that he may have made that remain outstanding.
2.5.3.
ASAA88 offer a wide range of withdrawal methods. Withdrawals can incur charges depending on the selected method. Any winnings above the amount stated in 2.5.4 can be withdrawn through the method chosen by the User for deposit. Information on the current fees for withdrawals is found on “My Account” and by clicking on “Withdrawals”. In addition, the User’s own bank may add a further handling charge. These charges may vary over time.
2.5.4.
ASAA88 reserve the right to credit the User back using the same method as that used by the User when depositing.
2.5.5.
ASAA88 reserve the right to request identification documents for all withdrawals.
2.5.6
In the interests of fair gaming, the User’s play will be reviewed before withdrawals are processed for any irregular or unusual playing patterns including but not limited to, equal, zero or low margin bets or hedge betting for play-through requirement purposes. Should ASAA88 deem that irregular game play has occurred, ASAA88 reserve the right to withhold any withdrawals and/or confiscate all winnings and bonuses.
2.5.7.
ASAA88 additionally reserves to right to request the documents discussed in 2.5.11 above for any account holder who has requested a withdrawal of any amount below USD 2,500.
2.5.8.
Withdrawals to credit / debit card are not possible to Visa or Visa electron and Mastercard.
2.5.9.
In line with the applicable laws, ASAA88 will remit amounts only to the same account from where the funds paid into User’s account originated.
2.6
Closing the User’s Member Account
2.6.1
The User may close his account at any time and ASAA88 will return to the User all funds from the User’s Member Account subject to the deduction of the relevant withdrawal charges. To close the User’s Member Account, the User must first cancel any offers for stakes that the User has made that remain outstanding.
2.6.2
The method of repayment will be at ASAA88’s absolute discretion.
2.6.3
ASAA88 reserves the right to close the User’s Member Account and to refund to the User the “Available to Bet” balance, subject to the deduction of any relevant withdrawal charges, at ASAA88’s absolute discretion and without any obligation to state a reason or give prior notice.
2.6.4
If the User does not log onto his Member Account via the internet, using his “User Name” and “Password” for a period of one (1) year, all balances may be removed from the User’s account after a notification has been sent to the registered e-mail address.
2.6.5
ASAA88 reserves the right to withhold and remove any bonuses awarded to the User if such bonuses have not been used within 6 month from the date when they were awarded.
2.6.6
Should a User use bonus funds to play on Games not included in Games that count towards meeting the bonus requirement, ASAA88 reserves the right to refuse withdrawals, remove bonus money and remove winnings without notice. ASAA88 are entitled to lock all accounts of players found abusing this rule.
3. The User’s obligations as a player
3.1.
The User hereby declares and warrants that:
3.1.1.
The User is eighteen (18) years of age or such higher minimum legal age of majority as stipulated in the laws of jurisdiction applicable to the User. The User shall not be prohibited from participating in the Games offered on the Website by any statutory rule of his jurisdiction;
3.1.2.
The User confirms that he will use this Website and the Member Account solely and exclusively for the purpose of the User’s genuine participation in the Games and not for any financial or other operations. The User’s participation in the Games will be strictly in the User’s personal non-professional capacity and used for recreational and entertainment reasons only;
3.1.3.
The User is to participate in the Games on his own behalf and not on behalf of any other person;
3.1.4.
All information that the User provides to ASAA88 during the term of validity of this agreement is true, complete, and correct, and the User shall immediately notify ASAA88 of any change of such information;
3.1.5.
The User is solely responsible for reporting and accounting for any gaming taxes applicable to him and payable to the applicable regulatory authority under relevant laws for any winnings that the User receives from ASAA88;
3.1.6.
The user confirms that all funds that the User deposits into the Member Account are not tainted with any illegality and, in particular, do not originate from any illegal activity or source;
3.1.7.
The User understands that by participating in the Games the User takes the risk of losing money deposited into the Member Account;
3.1.8.
The User shall not be involved in any fraudulent, collusive, fixing or other unlawful activity in relation to the User’s or third parties’ participation in any of the Games and shall not use any software-assisted methods or techniques or hardware devices for the User’s participation in any of the Games. ASAA88 hereby reserves the right to invalidate or close the Member Account or invalidate the User’s participation in a Game in the event of such behaviour;
3.1.9.
In relation to deposits and withdrawals of funds into and from the User’s Member Account, the User shall only use credit cards and other financial instruments that are valid and lawfully belong to him.
3.1.10.
The computer software that ASAA88 make available to the User is the property of ASAA88 or any other third parties or partners of ASAA88 and is protected by copyright and other applicable intellectual property laws. The User may only use the software for the User’s own personal, recreational uses in accordance with all rules, terms and conditions hereby established and in accordance with all applicable laws, rules and regulations.
3.1.11.
Games played on Website should be played in the same manner as games played in any other setting. The User shall be courteous to other Users and shall avoid rude or obscene comments, including but not limited to chat rooms.
3.2.
Inactive and Dormant Accounts
3.2.1.
If no transaction has been recorded on User’s account for twelve months the Member Account shall be deemed to be inactive. In such a case, after sending appropriate notification to the player on the 11th month, ASAA88 will deduct USD5.00 per month administrative fee from the User’s account. If, after ASAA88 have begun charging User’s account with the Administrative Fee, and before User’s account becomes dormant, User starts playing on Users account, ASAA88 will refund to Users account the administrative fees charged. In order to obtain a refund of administrative fees the User is expected to play and wager funds on the account and not solely by logging in. In such a case the User is requested to contact customer support. In the case where the user account is inactive for 30 months, therefore a log on has not been performed within the last 30 months, ASAA88 shall close User’s account.
4. Responsible gaming
4.1
You may at your discretion choose to exclude yourself from playing any Games on our Website. You may: • Set a limit on the amount you may wager within a specified period of time. • Set a limit on the losses you may incur within a period of time; • Set a limit on the amount of time you may play within one session; • Exclude yourself from playing for a definite or indefinite period.
4.2
In order to impose limits on your gaming you need to send an email to your local customer service at the address provided on www.www.asaa88.orgm indicating the following particulars “I want to be excluded from www.www.asaa88.orgm”, or alternatively visit www.www.asaa88.orgm and click on “Responsible Gaming”. A self-exclusion will take immediate effect following the receipt of your request by a customer service representative.
4.3
If you choose to exclude yourself for an indefinite period your account will be closed and you will be barred from re-registering on our Website .
4.4
When setting up your Member Account you may also choose to impose limits on your play. This means that you can only deposit and play with the amount you have pre-set for the next seven-day-period. You are not able to raise your limit during a running week, but are able to raise the maximum stake for the following week.
4.5.
Should you opt for self-exclusion in the manners contemplated above, then you will not be able to reverse this position for at least 7 days, after which you will be able to send an email to the same email address in order to re-activate your access to our Games and re-activate your Member Account.
5. Special rules
5.1
Certain provisions laid down in this section refer to the rules, terms and contractual provisions for specific games, which are found in a separate link from this page. The rules linked to this page form an integral part of these Terms and Conditions and the User shall be deemed to have accepted the special rules upon clicking the ‘ACCEPT’ button on this page.
6. Privacy policy
6.1.
The User hereby acknowledges and consents to ASAA88’s processing of the User’s personal data for the purposes of allowing the User access and use of the Website and in order to allow the User to participate in Games and to provide ancillary services to the User.
6.2.
ASAA88 will protect the User’s personal information and respect the User’s privacy in accordance with best business practices and applicable laws.
6.3.
ASAA88 will only use the User’s personal data to allow the User to participate in the Games and to carry out operations relevant to the User’s participation in the Games.
6.4.
ASAA88 shall also process the User’s personal data for the purposes of carrying out verification procedures in relation to the User’s participation in the Games.
6.5.
The User’s personal data will not be disclosed to third parties, unless such disclosure is necessary for processing of the User’s requests, such as effecting transactions on the User’s Member Account or participating in Games, to carry verification procedures or unless it is required by law. As ASAA88’s business partners or suppliers or service providers may be responsible for certain parts of the overall functioning or operation of the Website, personal data may be disclosed to them. The User hereby consents to all such disclosures.
6.6.
The User has the right to access personal data held by ASAA88 about him.
6.7.
The User must promptly inform ASAA88, by amending the User’s profile or otherwise, of any changes to information provided by the User at the time of registration and opening of the User’s Member Account.
6.8.
In order to provide the User with an efficient service, ASAA88 and/or its service providers may require the transfer of the User’s personal data from one country to another on a world-wide basis. The User hereby consents to the User’s personal data so transferred.
6.9.
In the processing of the User’s Member Account and associated transactions, ASAA88 may have recourse to credit rating agencies, fraud detection agencies, anti-money laundering agencies who may keep a record of the User’s information. The User hereby consents to such disclosures.
6.10.
In order to make the User’s visit to the Websites more user-friendly, to keep track of visits to the Websites and to improve the service, ASAA88 collects a small piece of information sent from the User’s browser, called a cookie. The User can, if he wishes, turn off the collection of cookies (please refer to the User’s browser instructions as to how to do this). The User must note, however, that turning off cookies may restrict the User’s use of the Websites or his overall experience.
6.11.
The User consents to ASAA88’s informing the User from time to time about changes on the Website, new services and promotions. If the User does not wish to receive direct marketing data the User may opt out of such service. The User can opt in again into receiving promotional material by emailing our support department.
7. Complaints
7.1.
User complaints can be made to:

7.1.3.
ASAA88 will use best efforts to resolve a reported matter promptly.
7.1.4.
If the User has a query with regard to any transaction, the User may also contact ASAA88 at support@ASAA88.com with details of the query. Representatives of ASAA88 will review any queried or disputed transactions. Decisions taken by ASAA88 are final and binding.
8. Limitation of liability
8.1.
The User enters the Website and participates in the Games at his own risk. The Websites and the Games are provided without any warranty whatsoever, whether express or implied.
8.2.
Without prejudice to the generality of the preceding provision, ASAA88, its directors, employees, partners, service providers:
8.2.1.
do not warrant that the software or the Website is/are fit for their purpose;
8.2.2.
do not warrant that the software and Website are free from errors;
8.2.3.
do not warrant that the Websites and/or Games will be accessible without interruptions;
8.2.4.
shall not be liable for any loss, costs, expenses or damages, whether direct, indirect, special, consequential, incidental or otherwise, arising in relation to the User’s use of the Websites or the User’s participation in the Games.
8.2.5.
The User hereby agrees to fully indemnify and hold harmless ASAA88, its directors, employees, partners, and service providers for any cost, expense, loss, damages, claims and liabilities howsoever caused that may arise in relation to the User’s use of the Website or participation in the Games.
9. Anti-money laundering reporting
9.1.
If the User becomes aware of any suspicious activity relating to any of the Games of the Website, the User must report this to ASAA88 immediately.
9.2.
ASAA88 may suspend, block or close the User’s Member Account and withhold funds if suspicions of money laundering occur in accordance with the Prevention of Money Laundering Act.
9.3.
Any suspicion of money laundering taking place through the Website shall be reported to the authorities for further investigation. Any funds due to the player may be confiscated by the company or transferred to the authorities.
10. Breaches, penalties and termination
10.1.
If the User breach any provision of these T&C or ASAA88 has a reasonable ground to suspect that the User has breached them, ASAA88 reserves the right, to suspend, close the Member Account, withhold any money in the User’s account (including the deposit) and apply such funds on account of any damages due by the User.
10.2.
If ASAA88 suspects that the User is engaged in illegal or fraudulent activities when using the Website; or in breach of this Agreement; or that the User has problems with creditors or otherwise there exists a situation which is detrimental to our business, ASAA88 may freeze or terminate the User’s account or cancel any stakes at ASAA88’s absolute discretion.
10.3.
The User acknowledges that ASAA88 shall be the final decision-maker of whether the User has violated ASAA88’s rules or terms or conditions. This may result in ASAA88’s suspension or permanent barring of the User from participation in our site.
11. Intellectual property
11.1.
ASAA88 is the sole owner of the trademark ASAA88 and the ASAA88 logo. Any unauthorised use of the ASAA88 trademark and the ASAA88 logo may result in prosecution.
11.2.
www.www.asaa88.orgm is the URL of ASAA88 and no unauthorized use may be made of this URL on another website or digital platform without our prior written consent.
11.3.
ASAA88 is the owner or the rightful licensee of the rights to the technology, software and business systems used within this Website.
11.4.
The contents and structure of ASAA88’s Website pages are subject to copyright © and database right in the name of ASAA88. All rights reserved. The copyright in this Website including all text, graphics, code, files and links belongs to ASAA88 and the site may not be reproduced, transmitted or stored in whole or in part without ASAA88’s written consent. The User’s registration and use of ASAA88’s system therefore does not confer any rights whatsoever to the intellectual property contained in our system.
11.5.
Links to the Website and any of the pages therein may not be included in any other website without the prior written consent of ASAA88.
11.6.
The User agrees not to use any automatic or manual device to monitor ASAA88 web pages or any content therein. Any unauthorized use or reproduction may be prosecuted.
12. Severability
12.1
If any provision of these T&C is held to be illegal or unenforceable, such provision shall be severed from these T&C and all other provisions shall remain in force unaffected by such severance.
13. Assignment
13.1
ASAA88 reserve the right to assign or otherwise lawfully transfer this Agreement. The User shall not assign or otherwise transfer this Agreement.
14. Entire Agreement and Admissibility
14.1.
This Agreement constitutes the entire agreement between the User and ASAA88 with respect to the Website and save in the case of fraud it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the User and ASAA88 with respect to this Website.
14.2.
A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
